We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (excluding payment card information) may be transferred unencrypted over various networks; payment card information is always encrypted during transfer. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission.
4. Accuracy & Completeness of Information
We are not responsible if information on this site is not accurate, complete, or current. The material is provided for general information only and should not be the sole basis for decisions. Product specifications, capacities, and performance figures are approximate and provided for guidance.
5. Products, Pricing & Availability
Prices are subject to change without notice. Certain products may be available exclusively online and in limited quantities. We reserve the right to limit quantities, discontinue any product, and refuse any order. We make every effort to display product colors and images accurately but cannot guarantee your display's accuracy. Machine specifications (power, output, dimensions) are approximate; confirm electrical and space requirements before ordering.
6. Orders, Billing & Account Information
You agree to provide current, complete, and accurate purchase and account information. We reserve the right to refuse or cancel any order, including after it has been placed, for reasons such as product availability, errors in pricing or product information, or suspected fraud.
7. Financing
Financing, where offered, may be provided by Top Churn LLC or a third-party partner and is subject to a separate agreement, credit approval, and terms disclosed at application. Any monthly-payment estimates shown on the site are illustrative only and do not constitute an offer of credit.
8. Shipping, Delivery & Freight
Machines ship by freight; smaller items ship by standard carrier. Delivery timelines are estimates and not guaranteed. You must inspect all machine shipments upon arrival and report any visible damage in writing within 48 hours of delivery. Title and risk of loss pass to you upon delivery to the carrier unless otherwise stated.
9. Warranty & Returns
Top Churn machines include a 2-year limited warranty on parts and workmanship, subject to the warranty documentation provided with the machine. Genuine replacement parts and support are available through Top Churn. Return eligibility, restocking fees, and freight responsibility are described in our Shipping & Returns policy. Ingredients and consumable items are non-returnable for food-safety reasons unless received damaged or defective.
10. Third-Party Links & Online Store
Our online store for parts and ingredients may operate on a third-party platform (Shopify) and/or a separate domain. Some links may direct you to third-party sites we do not control. We are not responsible for the content, terms, or privacy practices of those sites. Additional platform terms may apply to store purchases.
11. Prohibited Uses
You may not use the site or its content: for any unlawful purpose; to violate any laws or regulations; to infringe intellectual property; to harass, abuse, or discriminate; to submit false or misleading information; to upload malicious code; to interfere with security features; or to attempt unauthorized access. We may terminate your use of the Service for violating any prohibited use.
12. Disclaimer of Warranties; Limitation of Liability
Except for the express machine warranty in Section 9, the Service and all products are provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law, Top Churn LLC shall not be liable for any indirect, incidental, punitive, or consequential damages, including lost profits or business interruption. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless Top Churn LLC and its officers, employees, and affiliates from any claim or demand, including reasonable attorneys' fees, arising out of your breach of these Terms or violation of any law or third-party right.
14. Intellectual Property
All content on this site — text, graphics, logos, images, product renders, and the "Top Churn" name and marks — is the property of Top Churn LLC or its licensors and is protected by applicable intellectual-property laws. No right is granted to reproduce or use such material without our express written permission.
15. Changes to These Terms
We reserve the right to update or replace any part of these Terms by posting updates to our website. It is your responsibility to check this page periodically. Continued use following changes constitutes acceptance.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-law provisions.

These Terms, together with any policies posted on this site, constitute the entire agreement between you and Top Churn LLC and govern your use of the Service, superseding any prior agreements.
